On November 9, the Ministry of Public Function published the Guidelines of the Business Integrity Register and Badge in the Official Gazette of the Federation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

El objetivo de este instrumento es fomentar la cultura de integridad en el sector privado y simplificar el proceso de registro de las empresas que cuenten con una Pol\u00edtica de Integridad, que cumpla con lo dispuesto en el art\u00edculo 25 de la Ley General de Responsabilidades Administrativas, y comprometidas con el fomento de la cultura de \u00e9tica.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

Estos lineamientos establecen que, para poder registrarse en el Padr\u00f3n, las empresas deber\u00e1n de cumplir con sus obligaciones fiscales, de seguridad social e Infonavit, y no se encuentren sancionadas o impedidas para participar en procedimientos de contrataciones p\u00fablicas del gobierno federal.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Asimismo, se\u00f1alan que obtendr\u00e1n el Distintivo de Integridad Empresarial aquellas personas morales registradas en el Padr\u00f3n y que acreditaron que su pol\u00edtica de integridad cumple con lo dispuesto en el art\u00edculo 25 de la Ley General de Responsabilidades Administrativas.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Es de recordar, que la misma Ley General de Responsabilidades Administrativas, en su art\u00edculo 24 establece que la PERSONA MORAL ser\u00e1 sancionada cuando los actos vinculados con faltas administrativas graves sean realizados por personas f\u00edsicas que act\u00faen a su nombre o representaci\u00f3n y pretendan obtener beneficios para \u00e9sta, y en su Art. 25 establece que en la determinaci\u00f3n de la responsabilidad de la persona moral se valorar\u00e1 si cuenta con una\u00a0POL\u00cdTICA DE INTEGRIDAD.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Si bien es cierto, el registro en el Padr\u00f3n de Integridad Empresarial es voluntario, el contar con una Pol\u00edtica de Integridad, como se menciona en el p\u00e1rrafo que antecede, es una necesidad para evitar o en su caso minimizar la responsabilidad de la persona moral.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The objective of this instrument is to promote the culture of integrity in the private sector and simplify the registration process of companies that have an Integrity Policy, which complies with the provisions of article 25 of the General Law of Administrative Responsibilities and is committed to the promotion of the culture of ethics.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The guidelines establish that to register in the Register, companies must comply with their fiscal, social security, and Infonavit obligations, and are not sanctioned or prevented from participating in public procurement procedures of the federal government.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Likewise, they point out that those legal entities registered in the Register and that accredited that their Integrity Policy complies with the provisions of article 25 of the General Law of Administrative Responsibilities will obtain the Business Integrity Badge.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

It should be remembered that the same General Law of Administrative Responsibilities, in its article24 establishes that the LEGAL PERSON Will be sanctioned when the acts related to serious administrative faults are carried out by persons acting in their name or representation and intend to obtain benefits for it, and the article 25 establishes that in the determination of the responsibility of the legal person it will be assessed if it has an\u00a0INTEGRITY POLICY.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

While it is true, registration in the Business Integrity Register is voluntary, having an Integrity Policy, as mentioned in the preceding paragraph, is a necessity to avoid or, where appropriate, minimize the responsibility of the defaulting legal person.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
