La Ley Federal de Protecci\u00f3n a la Propiedad Industrial contempla una figura jur\u00eddica denominada MARCA COLECTIVA o MARCA DE CERTIFICACI\u00d3N. Las marcas colectivas o de certificaci\u00f3n son aquellas que protegen una denominaci\u00f3n e imagen y, que solo puede ser utilizada por los miembros de una asociaci\u00f3n o sociedad (titular) e incluso ser otorgadas por dependencias de la administraci\u00f3n p\u00fablica o de los gobiernos (Federal, Estatal o Municipal) para aquellos particulares cuando \u00e9stos cumplen con las normas o reglamentos para su uso (pertenencia a la regi\u00f3n, est\u00e1ndares de producci\u00f3n o prestaci\u00f3n de servicios, etc.).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Algunos ejemplos son: DISTINTIVO H (Secretar\u00eda de Turismo), ACSAA (Asociaci\u00f3n de Certificaci\u00f3n de Sector Agropecuario Alimentario, A.C.) CMFE EMPRESA FAMILIAR CERTIFICADA (Centro Mexicano de la Familia Empresaria, A.C.), entre otros.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

La MARCA COLECTIVA o MARCA DE CERTIFICACI\u00d3N permite a las asociaciones de empresarios, de productores o prestadores de servicio ampliar su base de asociados al presentar una ventaja competitiva sustentada en la emisi\u00f3n de reglas claras para la obtenci\u00f3n de la autorizaci\u00f3n de uso (equidad entre agremiados) y mayor penetraci\u00f3n en el mercado de sus productos o servicios (valor de marca) apoyado en la difusi\u00f3n de la MARCA COLECTIVA o MARCA DE CERTIFICACI\u00d3N.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Adem\u00e1s de la MARCA COLECTIVA o MARCA DE CERTIFICACI\u00d3N, las MARCAS (registro ordinario) pueden ser elementos de certificaci\u00f3n, ya que el licenciamiento de las mismas entre los agremiados de asociaciones permite la homologaci\u00f3n de calidad en los productos o servicios y evita la competencia desleal.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
