A partir del 1 de julio de 2020, entraron en vigor nuevas disposiciones en la Ley Federal del Derecho de Autor en M\u00e9xico, que buscan equilibrar la protecci\u00f3n de los derechos de los autores con el acceso a sus obras en contextos educativos, cient\u00edficos y de inter\u00e9s p\u00fablico. Reformas que fueron avaladas con el reciente fallo del 30 de mayo de 2024, en el que la Suprema Corte de Justicia de la Naci\u00f3n (SCJN) valid\u00f3 las reformas a la Ley Federal del Derecho de Autor y del C\u00f3digo Penal Federal, las cuales establecieron un mecanismo unilateral para el retiro de contenidos en internet que se presuman como violatorios de derechos de autor.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Estas nuevas normativas permiten la utilizaci\u00f3n de obras protegidas sin autorizaci\u00f3n del titular de los derechos en ciertos casos espec\u00edficos. Por ejemplo, se puede reproducir una obra para uso personal y privado, citar textos para cr\u00edtica o investigaci\u00f3n, y utilizar obras en contextos educativos y judiciales, siempre que no se afecte la explotaci\u00f3n normal de la obra ni se cause un perjuicio al autor. Adem\u00e1s, se permiten adaptaciones dom\u00e9sticas y copias para personas con discapacidad, as\u00ed como copias t\u00e9cnicas por organismos de radiodifusi\u00f3n.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Para las empresas, especialmente aquellas con \u00e1reas de publicidad y mercadotecnia, es crucial verificar que los materiales utilizados en redes sociales o medios de comunicaci\u00f3n electr\u00f3nica sean de autor\u00eda propia, de libre reproducci\u00f3n, o que se cuente con las licencias necesarias para su uso. No hacerlo puede tener serias repercusiones legales.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

El uso no autorizado de materiales protegidos por derechos de autor puede resultar en demandas costosas y da\u00f1os a la reputaci\u00f3n de la empresa.       As of July 1, 2020, new provisions came into force in the Federal Copyright Law in Mexico, which seek to balance the protection of authors’ rights with access to their works in educational, scientific, and public interest contexts. Reforms that were endorsed with the recent ruling of May 30, 2024, in which the Supreme Court of Justice of the Nation (SCJN) validated the reforms to the Federal Copyright Law and the Federal Penal Code, which established a unilateral mechanism for the removal of content on the internet that is presumed to violate copyright.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

In addition, home adaptations and copying for persons with disabilities are permitted, as well as technical copying by broadcasting organizations.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

      For companies, especially those with advertising and marketing areas, it is crucial to verify that the materials used in social networks or electronic media are of their own authorship, of free reproduction, or that they have the necessary licenses for their use. Failure to do so can have serious legal repercussions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
