El pasado 24 de diciembre de 2024, se public\u00f3 en el Diario Oficial de la Federaci\u00f3n (DOF) un Decreto por el cual se adicionan diversas disposiciones a la Ley Federal del Trabajo en materia de plataformas digitales, cre\u00e1ndose el cap\u00edtulo IX BIS, mismo que fue denominado como \u201cTrabajo en plataformas digitales\u201d y el cual establece dentro de otros, los siguientes lineamientos:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t
  • Se entender\u00e1 como trabajo en plataformas digitales, como aquella relaci\u00f3n laboral subordinada consiste en el desempe\u00f1o de una actividad remunerada que requiera la presencia f\u00edsica de la persona trabajadora para la prestaci\u00f3n de un servicio, el cual es gestionado por una persona f\u00edsica o moral a trav\u00e9s de una plataforma digital, utilizando las tecnolog\u00edas de la informaci\u00f3n y la comunicaci\u00f3n para ejercer el mando y la supervisi\u00f3n sobre la persona trabajadora.<\/li><\/ul>
    • Se entender\u00e1 por plataforma digital al conjunto de mecanismos, aplicaciones inform\u00e1ticas, sistemas y dispositivos que asignen tareas, servicios, obras, trabajos o similares a personas trabajadoras a favor de terceros.<\/li><\/ul>
      • Los usuarios, consumidores o beneficiarios de tareas, servicios, obras o trabajos, no ser\u00e1n considerados patrones, ni responsables solidarios.<\/li><\/ul>
        • El salario se fijar\u00e1 por tarea, servicio, obra o trabajo realizado; dicho pago contemplar\u00e1 el pago proporcional del d\u00eda de descanso semanal, vacaciones, prima vacacional, aguinaldo y horas extra.<\/li><\/ul>
          • El trabajo en plataformas digitales deber\u00e1 documentarse mediante un contrato de trabajo, mismo que deber\u00e1 ser autorizado y registrado por el Centro Federal de Conciliaci\u00f3n y Registro Laboral.<\/li><\/ul>
            • Los prestadores de servicios en plataformas digitales deber\u00e1n crear una pol\u00edtica de gesti\u00f3n algor\u00edtmica que establezca las reglas para la asignaci\u00f3n de tareas, servicios, obras o trabajos, a trav\u00e9s de algoritmos o mecanismos an\u00e1logos. Esta pol\u00edtica formar\u00e1 parte del contrato de trabajo.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

              Asimismo, estas personas trabajadoras tendr\u00e1n derecho a participar en las utilidades de la empresa y a las indemnizaciones que por despido establece la legislaci\u00f3n laboral.<\/div><\/div>

              On December 24, 2024, the Official Gazette of the Federation (DOF) published a Decree adding several provisions to the Federal Labor Law concerning digital platforms, including Chapter IX BIS, titled \u201cWork on Digital Platforms,\u201d which establishes, among other regulations, the following guidelines:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

              \n\t\t\t\t
              \n\t\t\t\t\t\t\t\t\t
                \n
              • Work on digital platforms is defined as a subordinate labor relationship involving the performance of a paid activity that requires the physical presence of the worker to provide a service. This service is managed by an individual or legal entity through a digital platform, utilizing information and communication technologies to exercise command and supervision over the worker.

                  \n
                • Digital platform refers to the set of mechanisms, software applications, systems, and devices that assign tasks, services, projects, or similar activities to workers for the benefit of third parties.

                  <\/li>\n<\/ul>\n
                    \n
                  • Users, consumers, or beneficiaries of tasks, services, projects, or work will not be considered employers or jointly liable parties.<\/li>\n<\/ul>\n
                      \n
                    • Wages will be determined per task, service, project, or work completed, and such payments must include proportional compensation for weekly rest days, vacation, vacation bonus, year-end bonus, and overtime.<\/li>\n<\/ul>\n
                        \n
                      • Work on digital platforms must be formalized through an employment contract, which must be authorized and registered by the Federal Center for Labor Conciliation and Registration.<\/li>\n<\/ul>\n
                          \n
                        • Service providers on digital platforms must create an algorithmic management policy that establishes the rules for assigning tasks, services, projects, or work through algorithms or similar mechanisms. This policy will be part of the employment contract.

                          Additionally, these workers will have the right to participate in the company\u2019s profits and receive the severance benefits stipulated by labor law in cases of dismissal.<\/p>\n
