El pasado 24 de mayo del a\u00f1o 2021 fue publicado en el Diario Oficial de la Federaci\u00f3n el Acuerdo por el que se dan a conocer las disposiciones de car\u00e1cter general para el registro de personas f\u00edsicas o morales que presten servicios especializados o ejecuten obras especializadas a que se refiere el art\u00edculo 15 de la Ley Federal del Trabajo.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

Conforme a lo dispuesto en su art\u00edculo \u00danico Transitorio, este Acuerdo entr\u00f3 en vigor al d\u00eda siguiente de su publicaci\u00f3n, por lo que es importante recordar que, a partir de esta fecha, las personas f\u00edsicas o morales que proporcionen servicios especializados o ejecuten obras especializadas tienen un plazo de 90 d\u00edas naturales para contar con su registro ante la Secretar\u00eda del Trabajo y Previsi\u00f3n Social (STPS).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

As\u00ed mismo, este Acuerdo establece en forma particular las siguientes disposiciones:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t
  1. Son sujetas de obtener el registro ante la STPS, aquellas personas f\u00edsicas o morales que ejecuten servicios especializados o realicen obras especializadas y que para ello proporcionen o pongan a disposici\u00f3n trabajadores propios en beneficio de otra para ejecutar los servicios o realizar las obras especializadas en los t\u00e9rminos a los que se refieren los art\u00edculos 13 y 15 de la Ley Federal del Trabajo.<\/li>
  2. Se establece el procedimiento que deber\u00e1n seguir las personas f\u00edsicas o morales para obtener su registro en el Padr\u00f3n P\u00fablico de Contratistas de Servicios Especializados u Obras Especializadas que formar\u00e1 la STPS.<\/li>
  3. Para solicitar el registro en el Padr\u00f3n se contar\u00e1 con una plataforma inform\u00e1tica a cargo de la STPS mediante la p\u00e1gina web http:\/\/repse.stps.gob.mx, a trav\u00e9s de la cual se inscribir\u00e1n las personas f\u00edsicas y morales que deseen obtener el registro, quienes deber\u00e1n cumplir los requisitos que se enuncian en el Acuerdo, destacando los siguientes:\u00a0
    1. Datos generales de las personas;<\/li>
    2. Encontrarse al corriente en sus obligaciones fiscales y de seguridad social frente al Servicio de Administraci\u00f3n Tributaria (SAT), al Instituto Mexicano del Seguro Social (IMSS) y al Instituto del Fondo Nacional para la Vivienda de los Trabajadores (INFONAVIT).<\/li>
    3. Deber\u00e1n establecer con precisi\u00f3n el servicio que desean prestar o el tipo de obra que desean ejecutar, para lo cual, deber\u00e1n acreditar el car\u00e1cter especializado con informaci\u00f3n y documentaci\u00f3n respecto a: capacitaci\u00f3n, certificaciones, permisos o licencias que regulan la actividad, equipamiento, tecnolog\u00eda, activos, capital social, maquinaria, nivel de riesgo, rango salarial promedio, experiencia, entre otros.<\/li>
    4. Los documentos que den base a lo anterior, independientemente de que la STPS tendr\u00e1 la facultad de solicitar informaci\u00f3n o documentaci\u00f3n adicional en caso de considerarlo necesario.<\/li><\/ol><\/li>
    5. La STPS a trav\u00e9s de la Plataforma deber\u00e1 pronunciarse respecto a la solicitud de registro dentro de los 20 d\u00edas h\u00e1biles posteriores a la recepci\u00f3n de la misma a trav\u00e9s de la Plataforma. De no hacerlo, los solicitantes podr\u00e1n requerir a la STPS, para que emita el aviso de registro correspondiente dentro de los tres d\u00edas h\u00e1biles siguientes a la presentaci\u00f3n del requerimiento. Transcurrido dicho plazo sin que se haya emitido el aviso de registro se tendr\u00e1 por efectuado el registro para los efectos legales a que haya lugar.<\/li>
    6. Una vez cumplidos todos los requerimientos establecidos para la obtenci\u00f3n del Registro ante el Padr\u00f3n, la STPS proceder\u00e1 a la inscripci\u00f3n correspondiente y en su caso, emitir\u00e1 el aviso de registro correspondiente.<\/li>
    7. El aviso tendr\u00e1 una vigencia de tres a\u00f1os y podr\u00e1 ser negado cuando no se acredite el cumplimiento de los requerimientos antes mencionados, o en su caso, podr\u00e1 ser cancelado cuando:
      1. Se presten servicios u obras especializadas no registradas;<\/li>
      2. Se presten servicio u obras especializadas que formen parte del objeto social o actividad econ\u00f3mica preponderante de la beneficiaria;<\/li>
      3. Existan adeudos por cr\u00e9ditos firmes derivados del incumplimiento de obligaciones fiscales y de seguridad social frente al SAT, al IMSS y al INFONAVIT;<\/li>
      4. Se deje de cumplir con los requisitos que sirvieron de base para el otorgamiento del registro;<\/li>
      5. Se incumpla lo establecido a la Ley Federal del Trabajo en materia de subcontrataci\u00f3n;<\/li>
      6. Se niegue atender cualquier requerimiento de informaci\u00f3n o documentaci\u00f3n que sea solicitada por la STPS; y<\/li>
      7. No se realice en el plazo establecido, la renovaci\u00f3n que se se\u00f1ala en el segundo p\u00e1rrafo del art\u00edculo 15 de la Ley Federal del Trabajo.<\/li><\/ol><\/li>
      8. Las personas f\u00edsicas o morales que obtengan el registro estar\u00e1n obligadas a identificar plenamente a sus trabajadores mediante la imagen, nombre, gafete o c\u00f3digo de identidad que vincule a dichos trabajadores con la empresa que presta el servicio especializado o ejecuta la obra especializada durante el desarrollo de sus labores en las instalaciones de la empresa que contrata los servicios.<\/li>
      9. En los contratos que las empresas contratantes celebren con empresas que prestan servicios especializados o ejecutan obras especializadas deber\u00e1 constar el registro y folio de la actividad u obra especializada vigente de dichas empresas.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        \n\t\t\t\t\t\t\t\t\t

        Recomendamos hacer un an\u00e1lisis de sus relaciones comerciales para poder determinar si se encuadran como un prestador de servicios u obras especializadas o en su caso, reciben los servicios u obras especializadas de alg\u00fan proveedor, ya que en cualquiera de los casos, se deber\u00e1 cumplir con la obtenci\u00f3n del Registro ante la STPS y celebrar y\/o modificar los contratos de prestaci\u00f3n de servicios correspondientes, considerando que si bien es cierto que se tienen 90 d\u00edas naturales para ello, el tiempo de respuesta de la STPS ser\u00e1 con un m\u00e1ximo de 20 d\u00edas h\u00e1biles, m\u00e1s tres d\u00edas h\u00e1biles posteriores a requerir la respuesta en caso de omisi\u00f3n de la STPS.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        On May 24th, 2021, an Agreement was published in the Official Gazette of the Federation by which the general provisions for the registration of natural or legal persons that provide specialized services or execute specialized works referred to within Article 15 of the Federal Labor Law.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        \n\t\t\t\t
        \n\t\t\t\t\t\t\t\t\t

        In accordance with the provisions of its Sole Transitory Article, this Agreement entered into force the day after its publication, so it is important to remember that, as of this date, natural or legal persons that provide specialized services or carry out specialized works have a period of 90 calendar days to obtain their registration from the Ministry of Labor and Social Welfare (STPS).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        \n\t\t\t\t
        \n\t\t\t\t\t\t\t\t\t

        Likewise, this Agreement establishes the following provisions in particular:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

        \n\t\t\t\t
        \n\t\t\t\t\t\t\t\t\t
        1. These are subject to registration before the STPS, individuals or legal entities that execute specialized services or carry out specialized works and to this effect provide or make available their own workers for the benefit of another to execute the services or carry out specialized works in the terms referred to in articles 13 and 15 of the Federal Labor Law.<\/li>
        2. The procedure to be followed by natural or legal persons to register within the Public Register of Specialized Service Contractors or Specialized Works that will be created by the STPS is established.<\/li>
        3. To be included within the Register, there will be an online platform headed by the STPS through the following web page http:\/\/repse.stps.gob.mx, through which the natural and legal persons who wish to be registered must sign up and meet the requirements set forth in the Agreement, emphasizing the following:\u00a0
          1. Personal data of individuals;\u00a0<\/li>
          2. Be up to date with their tax and social security obligations before the Tax Administration Service (SAT), the Mexican Institute of Social Security (IMSS) and the Institute of the National Fund for Workers’ Housing (INFONAVIT).<\/li>
          3. They must precisely establish the service they wish to provide or the type of work they wish to execute, for which, they must prove the specialized nature with information and documentation regarding training, certifications, permits or licenses that regulate the activity, equipment, technology, assets, capital stock, machinery, risk level, average salary range, experience, among others.<\/li>
          4. The documents that provide the basis for the foregoing, regardless of the fact that the STPS will have the power to request additional information or documentation if it deems it necessary.<\/li><\/ol><\/li>
          5. The STPS must rule on a registration request through the Platform within 20 business days after receiving it through the Platform. Failure to do so on behalf of the STPS will grant applicants the ability to request the STPS to issue the corresponding registration notice within three business days after the submission of this request. Once said period has elapsed without the registration notice having been issued, the registration will be deemed to have been carried out for the legal purposes that may arise.<\/li>
          6. Once all the requirements established for inclusion into the Register have been fulfilled, the STPS will proceed to the corresponding registration and, where appropriate, will issue the corresponding registration notice.<\/li>
          7. The notice will be valid for three years and may be denied when compliance with the aforementioned requirements is not proven, or where appropriate, it may be canceled when:\u00a0
            1. Unregistered specialized services or works are rendered;
              b. \u00a0 \u00a0Specialized services or works are provided that are part of the main corporate purpose or economic activity of the beneficiary;
              c. \u00a0 \u00a0There are outstanding debts for due blanaces derived from non-compliance with tax and social security obligations against the SAT, the IMSS and the INFONAVIT;
              d. \u00a0 \u00a0The requirements that served as the basis for granting the registration are no longer met;<\/li>
            2. e. \u00a0 \u00a0Failure to comply with the provisions of the Federal Labor Law regarding subcontracting;
              f. \u00a0 \u00a0Refusal to meet any request for information or documentation that from the STPS; and
              g. \u00a0 \u00a0The renewal indicated in the second paragraph of article 15 of the Federal Labor Law is not carried out within the established period.<\/li><\/ol><\/li>
            3. The natural or legal persons who obtain the registration will be obliged to fully identify their workers by means of their image, name, badge or identity code which links said workers with the company that provides the specialized service or executes the specialized work during the development of their labor within the facilities of the company which hires these services.<\/li>
            4. The current registration and file numbers of the companies who provide specialized services or works must be included within the agreements of said companies.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

              \n\t\t\t\t\t\t\t\t\t

              We recommend carrying out an analysis of your business relationships in order to determine if they fall under the framework a specialized service or works provider or, if applicable, if you receive specialized services or works from a supplier, since in any of these cases, you must comply with obtaining a Registration before the STPS and enter into and\/or modify the corresponding provision services agreements, considering that although it is true that there are 90 calendar days for this, the response time of the STPS will be a maximum of 20 business days, plus three additional business days after requesting a response in the event of an omission on behalf of the the STPS.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
