de la Federaci\u00f3n el Decreto por el que se Reforman diversas disposiciones a la Ley Federal del Trabajo, la Ley del Seguro Social, la Ley del Fondo Nacional de la Vivienda para los Trabajadores, el C\u00f3digo Fiscal de la Federaci\u00f3n, la Ley del Impuesto Sobre la Renta, la Ley del Impuesto al Valor Agregado, Ley Federal de los Trabajadores al Servicio del Estado, Reglamentaria del Apartado B) del Art\u00edculo 123 Constitucional y a La Ley Reglamentaria de la Fracci\u00f3n XIII Bis del Apartado B, del Art\u00edculo 123 de la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos, en Materia de Subcontrataci\u00f3n Laboral.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-764f6a2d elementor-widget elementor-widget-text-editor\" data-id=\"764f6a2d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Conforme a lo dispuesto en su art\u00edculo Primero Transitorio, este Decreto entr\u00f3 en vigor al d\u00eda siguiente de su publicaci\u00f3n, por lo que es importante recordar que a partir de esta fecha queda prohibida la subcontrataci\u00f3n de personal, entendi\u00e9ndose esta cuando un persona f\u00edsica o moral proporciona o pone a disposici\u00f3n trabajadores propios en beneficio de otra, permiti\u00e9ndose \u00fanicamente la subcontrataci\u00f3n de servicios especializados o ejecuci\u00f3n de obras especializadas que no formen parte del objeto social ni de la actividad econ\u00f3mica preponderante de la beneficiaria de estos, incluyendo los servicios u obras complementarias o compartidas prestadas entre empresas de un mismo grupo empresarial.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6dbb93fa elementor-widget elementor-widget-text-editor\" data-id=\"6dbb93fa\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>As\u00ed mismo, conforme al resto de los art\u00edculos Transitorios publicados en este Decreto, es importante tener presente los siguientes plazos para considerar su entrada en vigor:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2676bd45 elementor-widget elementor-widget-text-editor\" data-id=\"2676bd45\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li>La Secretar\u00eda del Trabajo y Previsi\u00f3n Social cuenta con un plazo de 30 d\u00edas naturales siguientes a la entrada en vigor de este Decreto para expedir las disposiciones de car\u00e1cter general para la tramitaci\u00f3n del registro que deben obtener las personas f\u00edsicas o morales que presten servicios de subcontrataci\u00f3n.<\/li><li>Las personas f\u00edsicas o morales que presten servicios de subcontrataci\u00f3n deber\u00e1n obtener el registro ante la Secretar\u00eda del Trabajo y Previsi\u00f3n Social en un plazo de 90 d\u00edas naturales, contados a partir de la publicaci\u00f3n de las disposiciones de car\u00e1cter general.<\/li><li>Las empresas que cuenten con un r\u00e9gimen de subcontrataci\u00f3n contar\u00e1n con un plazo de 90 d\u00edas a partir de la entrada en vigor del Decreto para transferir mediante una sustituci\u00f3n patronal, a los trabajadores de la empresa contratista a la beneficiaria de estos, sin que se deba cumplir con el requisito de transmitir los bienes del patr\u00f3n sustituido. En todo caso se deber\u00e1n reconocer los derechos laborales, incluida su antig\u00fcedad, que se hubieran generado por el efecto de la relaci\u00f3n de trabajo.<\/li><li>Las modificaciones realizadas al C\u00f3digo Fiscal de la Federaci\u00f3n, Ley de Impuesto Sobre la Renta y Ley del Impuesto al Valor Agregado entrar\u00e1n en vigor el 1 de agosto de 2021.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2299c54c elementor-widget elementor-widget-text-editor\" data-id=\"2299c54c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En Rivadeneyra, Trevi\u00f1o y de Campo S.C., le estamos dando seguimiento a este tema y hemos estructurado diversas estrategias para su implementaci\u00f3n para poder bridarle la asesor\u00eda legal que en su caso requiera. El contenido no debe considerarse como un consejo u opini\u00f3n legal.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1f253564 elementor-widget elementor-widget-text-editor\" data-id=\"1f253564\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<div><p dir=\"ltr\">Esperando que la presente informaci\u00f3n sea de su utilidad, quedamos a sus \u00f3rdenes para cualquier duda o comentario adicional que pudieran surgir al respecto.<\/p><div>\u00a0<\/div><\/div><div>\u00a0<br \/><br \/><\/div><div>Atentamente,<\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-5c3d2582 e-con-full e-flex e-con e-child\" data-id=\"5c3d2582\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-327c102a elementor-widget elementor-widget-text-editor\" data-id=\"327c102a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Last Friday, April 23<sup>rd<\/sup>, 2021, a Decree that reformed various provisions of the Federal Labor Law, the Social Security Law, the National Housing Fund for Workers Law, the Federal Tax Code, the Income Tax Law, the Value Added Tax Law, and the Federal Law for Workers at the Service of the State, which regulates Section B) of Constitutional Article 123 and the Regulatory Law of Section B\u2019s Sub Section XIII, of Article 123 of Mexico\u2019s Constitution, in regard to Labor Subcontracting Matters.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-30f97158 elementor-widget elementor-widget-text-editor\" data-id=\"30f97158\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In accordance with the provisions of its First Transitory Article, this Decree entered into force the day after its publication, so it is important to remember that from this date the subcontracting of personnel is prohibited, this being when a natural or legal person provides or makes its own workers available for the benefit of another, allowing only the subcontracting of specialized services or execution of specialized works that are not part of the corporate purpose or the main economic activity of the beneficiary of these, including complementary or shared services or works loaned between companies of the same business group.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-529b07d7 elementor-widget elementor-widget-text-editor\" data-id=\"529b07d7\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Likewise, in accordance with the rest of the Transitory articles published in this Decree, it is important to keep in mind the following deadlines to consider after its entry into force:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-46f6b98f elementor-widget elementor-widget-text-editor\" data-id=\"46f6b98f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li>The Ministry of Labor and Social Security has a period of 30 calendar days following the entry into force of the Decree to issue the general provisions for processing the registration that individuals or legal entities who provide subcontracting services must obtain.<\/li><li>Individuals or legal entities that provide subcontracting services must obtain registration from the Ministry of Labor and Social Welfare within a period of 90 calendar days, counted from the publication of the general provisions.<\/li><li>Companies that have a subcontracting regime will have a period of 90 days from the entry into force of the Decree to transfer, through employer substitution, the workers of the contractor company to the beneficiary, without being obligated to comply with the requirement to transfer the substitute employer\u2019s assets.
