El 12 de julio de 2022, se public\u00f3 en el Diario Oficial de la Federaci\u00f3n, el\u00a0ACUERDO DE CAR\u00c1CTER GENERAL DE INICIO DE EMERGENCIA POR OCURRENCIA DE SEQU\u00cdA SEVERA EXTREMA O EXCEPCIONAL EN CUENCAS PARA EL A\u00d1O 2022<\/u><\/strong>, a trav\u00e9s del cual, la Comisi\u00f3n Nacional del Agua (CNA) ha\u00a0ordenado tomar las medidas preventivas y de mitigaci\u00f3n<\/u><\/strong>\u00a0necesarias para garantizar el abastecimiento de los usos dom\u00e9sticos y p\u00fablicos de dicho recurso \u2013el agua- ante el fen\u00f3meno natural de sequ\u00eda en su modalidad severa.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Por tanto, los titulares de concesiones para la explotaci\u00f3n, uso o aprovechamiento de aguas nacionales, adem\u00e1s de implementar las medidas preventivas y de mitigaci\u00f3n de la sequ\u00eda, previstas en el\u00a0Programa del Consejo de Cuenca que les corresponda<\/strong>; podr\u00e1n, principalmente de los usos industrial y agr\u00edcola y cuando haya baja disponibilidad en las fuentes de abastecimiento de agua potable, lo siguiente:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t
  1. Dar aviso a la autoridad del agua, para proporcionar a terceros en forma provisional el uso total o parcial de las aguas concesionadas;<\/li>
  2. Ceder o transmitir temporalmente a la autoridad del agua, sus derechos y solicitar la interrupci\u00f3n a de la caducidad de los vol\u00famenes concesionados que no utilicen, en tanto subsiste la emergencia, de conformidad con lo previsto por el art\u00edculo 29 BIS 3, fracci\u00f3n VI, numeral 4 de la Ley de Aguas Nacionales;<\/li>
  3. Para el caso anterior y trat\u00e1ndose de los usos industriales y agr\u00edcolas, la autoridad del agua, verificar\u00e1 que los vol\u00famenes que se transfieran o cedan temporalmente, se entreguen directamente a la red de distribuci\u00f3n en coordinaci\u00f3n con el organismo operador, en tanto subsista la emergencia. En el caso de otros usos, se analizar\u00e1 tambi\u00e9n la conveniencia de una conexi\u00f3n directa a la red.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Aunado a lo anterior, la CNA concert\u00f3 en el seno de los Consejos de Cuenca, que los 26 Programas de Medidas Preventivas y de Mitigaci\u00f3n de la Sequ\u00eda, deber\u00e1n\u00a0contener las medidas transitorias<\/u><\/strong>\u00a0que podr\u00e1n implementar ante tal situaci\u00f3n; afectando a los estado de Baja California, Baja California Sur, Alto Noroeste, Sonora, Chihuahua, Sinaloa, Coahuila, Nuevo Le\u00f3n, Tamaulipas, Durango, Zacatecas, San Luis Potos\u00ed, Guanajuato, Jalisco, Michoac\u00e1n, Nayarit, Hidalgo, Estado de M\u00e9xico, valle de Toluca, Quer\u00e9taro, Oaxaca, Guerrero; entre \u00e9stas, se prev\u00e9 la limitaci\u00f3n temporal a los derechos de\u00a0agua existentes, a trav\u00e9s de la reducci\u00f3n provisional de vol\u00famenes a los usuarios de las cuencas que se encuentren en condici\u00f3n de sequ\u00eda severa, extrema o excepcional<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    Es importante entender que los 26 Programas de Medidas Preventivas y de Mitigaci\u00f3n, formulados respectivamente por los Consejos de Cuenca est\u00e1n conformados por Baja California, Baja California Sur, Alto Noroeste, R\u00edos Yaqui y M\u00e1tape, R\u00edo Mayo, R\u00edos Fuerte y Sinaloa, R\u00edos Mocorito al Quelite, R\u00edos Presidio al San Pedro, Costa de Guerrero, Costa de Oaxaca, R\u00edo Bravo, R\u00edo Balsas, Nazas-Aguanaval, Del Altiplano, Lerma-Chapala, R\u00edo Santiago, Costa Pac\u00edfico Centro, R\u00edos San Fernando-Soto la Marina, R\u00edo P\u00e1nuco, R\u00edos Tuxpan al Jamapa, R\u00edo Papaloapan, R\u00edo Coatzacoalcos, Costa de Chiapas, R\u00edos Grijalva y Usumacinta, Pen\u00ednsula de Yucat\u00e1n y Valle de M\u00e9xico.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    Las medidas anteriores se adoptar\u00e1n sin perjuicio de\u00a0otras que resulten procedentes<\/u><\/strong>\u00a0por parte de la CNA, y de aquellas que, en el \u00e1mbito de sus respectivas competencias, ejecuten otras autoridades con la plena finalidad de enfrentar el fen\u00f3meno de sequ\u00eda severa que sufre el pa\u00eds.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    On July 12, 2022, was published in the Official Gazette of the Federation, the\u00a0AGREEMENT OF A GENERAL NATURE OF EMERGENCY INITIATION FOR THE OCCURRENCE OF EXTREME OR EXCEPTIONAL SEVERE DROUGHT IN BASINS FOR THE YEAR 2022<\/strong>, through which, the National Water Commission (CNA) has\u00a0ordered to take the necessary preventive and mitigation measures<\/strong>\u00a0to guarantee the supply of domestic and public uses of said resource – water – before the natural phenomenon of drought in its severe modality.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Therefore, the holders of concessions for the exploitation, use or exploitation of national waters, in addition to implementing the preventive and drought mitigation measures, provided for in the\u00a0Basin Council Program that corresponds\u00a0<\/strong>to them; may, in particular from industrial and agricultural uses and where there is low availability in sources of drinking water supply, the following:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    1. Give\u00a0notice\u00a0to\u00a0the\u00a0water\u00a0authority,\u00a0to\u00a0provide\u00a0third\u00a0parties\u00a0on\u00a0a\u00a0provisional\u00a0basis\u00a0with\u00a0the\u00a0total\u00a0or\u00a0partial\u00a0use\u00a0of\u00a0the\u00a0concessioned<\/li>
    2.
