Federaci\u00f3n un Decreto por el que se reformaron y adicionaron diversas disposiciones a la \u201cLey General para Prevenir, Sancionar y Erradicar los Delitos en Materia de Trata de Personas y para la Protecci\u00f3n y Asistencia a las V\u00edctimas de estos Delitos\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-77625266 elementor-widget elementor-widget-text-editor\" data-id=\"77625266\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Uno de los principales cambios dentro de esta reforma, fue la adici\u00f3n de una nueva fracci\u00f3n al art\u00edculo 21 de la legislaci\u00f3n mencionada, por medio de la cual se estableci\u00f3 que ser\u00e1n consideradas como explotaci\u00f3n laboral las \u201cjornadas de trabajo por encima de la Ley\u201d, se\u00f1al\u00e1ndose tambi\u00e9n dentro del mismo ordenamiento que las personas que cometan el delito de <em>explotaci\u00f3n laboral<\/em> podr\u00e1n ser sancionadas con una pena de entre 3 y 10 a\u00f1os de prisi\u00f3n, as\u00ed como de 5 mil a 50 mil d\u00edas multa.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7ac5ed3f elementor-widget elementor-widget-text-editor\" data-id=\"7ac5ed3f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Es fundamental para las empresas contar con una comprensi\u00f3n clara de lo que se considera \u00abjornadas de trabajo por encima de la Ley\u00bb para evitar cualquier posible responsabilidad legal. La Ley Federal del Trabajo es la legislaci\u00f3n correcta para establecer los l\u00edmites m\u00e1ximos permitidos en las jornadas laborales. Asimismo, dentro de esa Ley se contempla la opci\u00f3n de realizar jornadas extraordinarias, siempre y cuando se respeten los l\u00edmites espec\u00edficos establecidos y se otorgue la compensaci\u00f3n adicional correspondiente. Es importante destacar que la realizaci\u00f3n de jornadas extraordinarias no implica autom\u00e1ticamente la comisi\u00f3n de alg\u00fan delito conforme a lo estipulado en la \u00abLey General para Prevenir, Sancionar y Erradicar los Delitos en Materia de Trata de Personas y para la Protecci\u00f3n y Asistencia a las V\u00edctimas de estos Delitos\u00bb.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-732b32b6 elementor-widget elementor-widget-text-editor\" data-id=\"732b32b6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Adicionalmente, es necesario distinguir que el delito de explotaci\u00f3n laboral nace a partir del sometimiento de una persona y, en general, del da\u00f1o a la dignidad humana, siendo esto precisamente un tipo penal regulado, penado y tipificado por una legislaci\u00f3n espec\u00edfica, ajena a la Ley Federal del Trabajo. Por todo lo anterior, creemos que los patrones que cumplan con los par\u00e1metros establecidos por la Ley Federal del Trabajo, aun incurriendo su personal en jornadas extraordinarias de labores, no se encuentran dentro del alcance de la presente reforma, siempre y cuando se cuiden los l\u00edmites establecidos para tal efecto y se cubran las remuneraciones correspondientes.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-70e52f61 elementor-widget elementor-widget-text-editor\" data-id=\"70e52f61\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>We recommend reviewing the shifts of your personnel, taking care to comply with the legal maximums established by the Federal Labor Law, avoiding as much as possible that they work overtime for more than three hours a day and more than three times a week. The Federal Labor Law is the correct legislation to rule the maximum limits allowed during workdays. Also, in such Law, the option of performing extra shifts is observed, if the specific limits established are respected and the corresponding additional compensation is granted. It is important to note that overtime during work shifts does not automatically imply the commission of a crime as stipulated in the \u201cGeneral Law to Prevent, Punish and Eradicate Crimes in the Matter of Trafficking in Persons and for the Protection and Assistance to the Victims of these Crimes\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4a9f11fd elementor-widget elementor-widget-text-editor\" data-id=\"4a9f11fd\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Additionally, it is necessary to distinguish that the crime of labor exploitation arises from the subjugation of a person and, in general, from harm to human dignity, this being precisely a criminal type regulated, punished and typified by a specific legislation, unrelated to the Federal Labor Law.
