conductas delictivas, consider\u00f3 necesario el normar la emisi\u00f3n de un documento que acredite la legal tenencia de los bienes trasladados en territorio nacional. Raz\u00f3n por la cual bajo el amparo del C\u00f3digo Fiscal de la Federaci\u00f3n (CFF) gener\u00f3 la obligaci\u00f3n de la emisi\u00f3n de la factura electr\u00f3nica con Complemento Carta Porte (CCP), misma que entr\u00f3 en vigor el 1 de enero de 2022.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5839e5a6 elementor-widget elementor-widget-text-editor\" data-id=\"5839e5a6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Recordemos, que mediante el Comunicado n\u00famero 084\/2021 la Secretar\u00eda de Hacienda y Cr\u00e9dito P\u00fablico (SHCP) se\u00f1alaba en el numeral 1 del s\u00e9ptimo p\u00e1rrafo lo siguiente: \u201c1. El complemento Carta Porte entrar\u00e1 en vigor el 1 de enero de 2022\u201d. Pero por la situaci\u00f3n que se ha presentado en el proceso de incorporaci\u00f3n por parte de algunos usuarios, el Servicio de Administraci\u00f3n Tributaria (SAT) inform\u00f3 que el periodo de transici\u00f3n para emitir el referido Complemento de Carta Porte sin sanciones se extender\u00e1 hasta el 30 de septiembre de 2022.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-16386b2f elementor-widget elementor-widget-text-editor\" data-id=\"16386b2f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Seg\u00fan informaci\u00f3n proporcionada por el SAT a trav\u00e9s de los medios institucionales: \u201cson m\u00e1s de 57 mil contribuyentes que a la fecha ya emiten sus facturas electr\u00f3nicas con el complemento Carta Porte, el cual consiste en la digitalizaci\u00f3n de la informaci\u00f3n relacionada con el traslado de bienes y mercanc\u00edas en todo el territorio nacional, en cualquier modo de transporte\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f74d5aa elementor-widget elementor-widget-text-editor\" data-id=\"f74d5aa\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>No hay que perder de vista que aunque se busca que las empresas se sumen a la lucha contra la competencia desleal de quienes se encuentran en la econom\u00eda informal o recurren al contrabando; la emisi\u00f3n del Complemento de Carta Porte no exime a los contribuyentes de seguir cumpliendo con obligaciones como la prevista en el art\u00edculo 146 de la Ley Aduanera, es decir, independientemente del complemento de carta porte, los bienes de procedencia extranjera deber\u00e1n acreditar su legal importaci\u00f3n con cualquiera de los siguientes supuestos:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-10a8d840 elementor-widget elementor-widget-text-editor\" data-id=\"10a8d840\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Documentaci\u00f3n aduanera que acredite su legal importaci\u00f3n, o bien, los documentos electr\u00f3nicos o digitales, que de acuerdo con las disposiciones legales aplicables y las reglas que al efecto emita el Servicio de Administraci\u00f3n Tributaria, acrediten su legal tenencia, transporte o manejo.<\/li><li>Nota de venta expedida por autoridad fiscal federal o instituci\u00f3n autorizada por \u00e9sta, o la documentaci\u00f3n que acredite la entrega de las mercanc\u00edas por parte de la SHCP.<\/li><li>Comprobante fiscal digital que deber\u00e1 reunir los requisitos que se\u00f1ale el CFF. \u00a0 \u00a0\u00a0<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3794970f elementor-widget elementor-widget-text-editor\" data-id=\"3794970f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En Rivadeneyra, Trevi\u00f1o y de Campo S.C. le estamos dando seguimiento a este tema, por lo que nuestros abogados del \u00e1rea de Comercio Exterior se encuentran a sus \u00f3rdenes para asesorar en el cumplimiento a las disposiciones aqu\u00ed mencionadas y guiarlos en el proceso correspondiente.
