los ciudadanos la publicaci\u00f3n de una reforma en el inciso A), numeral 2 del Art\u00edculo 3 de la Constituci\u00f3n Pol\u00edtica de la Ciudad de M\u00e9xico a trav\u00e9s de la Gaceta Oficial.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4c476ff9 elementor-widget elementor-widget-text-editor\" data-id=\"4c476ff9\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Antes de la reforma, el texto constitucional establec\u00eda:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-68d3a93c elementor-widget elementor-widget-text-editor\" data-id=\"68d3a93c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em>\u201cArt\u00edculo 3. De los principios rectores<\/em><\/p><p><em>1.(\u2026)<\/em><\/p><p><em>2. La Ciudad de M\u00e9xico asume como principios:<\/em><\/p><p><em>A) El respeto a los derechos humanos, la defensa del Estado democr\u00e1tico y social, el di\u00e1logo social, la cultura de la paz y la no violencia, el desarrollo econ\u00f3mico sustentable y solidario con visi\u00f3n metropolitana, la m\u00e1s justa distribuci\u00f3n del ingreso, la dignificaci\u00f3n del trabajo y el salario, la erradicaci\u00f3n de la pobreza, <strong>el respeto a la propiedad privada<\/strong>, la igualdad sustantiva, la no discriminaci\u00f3n, la inclusi\u00f3n, la accesibilidad, el dise\u00f1o universal, la preservaci\u00f3n del equilibrio ecol\u00f3gico, la protecci\u00f3n al ambiente, la protecci\u00f3n y conservaci\u00f3n del patrimonio cultural y natural. Se reconoce la propiedad de la Ciudad sobre sus bienes del dominio p\u00fablico, de uso com\u00fan y del dominio privado; asimismo, la propiedad ejidal y comunal\u201d<\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-49415f33 elementor-widget elementor-widget-text-editor\" data-id=\"49415f33\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Ahora bien, con la reforma qued\u00f3 de la siguiente manera:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3bf9dc elementor-widget elementor-widget-text-editor\" data-id=\"3bf9dc\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em>\u201cArt\u00edculo 3. De los principios rectores<\/em><\/p><p><em>\u00a01.\u00a0<\/em><em style=\"font-size: 14px; color: var( --e-global-color-d2d48d7 );\">(\u2026)<\/em><\/p><p><em style=\"font-size: 14px; color: var( --e-global-color-d2d48d7 );\">2. Se reconoce la propiedad de la Ciudad sobre sus bienes del dominio p\u00fablico, de uso com\u00fan y del dominio privado; asimismo, la propiedad ejidal y comunal;\u201d<\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-20cbd7c6 elementor-widget elementor-widget-text-editor\" data-id=\"20cbd7c6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>De lo anterior, se advierte que lo medular de esta reforma consiste en que la propiedad privada en la ciudad de M\u00e9xico ahora ser\u00e1 respetada en t\u00e9rminos del art\u00edculo 27 de la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos (CPEUM).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-560f5d0 elementor-widget elementor-widget-text-editor\" data-id=\"560f5d0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Pero \u00bfQu\u00e9 establece dicho art\u00edculo respecto de la propiedad privada?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-de45c61 elementor-widget elementor-widget-text-editor\" data-id=\"de45c61\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em>\u201cArt\u00edculo 27. <strong>La propiedad de las tierras y aguas comprendidas dentro de los l\u00edmites del territorio nacional corresponde originariamente a la Naci\u00f3n<\/strong>, la cual ha tenido y <strong>tiene el derecho de transmitir el dominio de ellas a los particulares,<\/strong> constituyendo la propiedad privada.<\/em><\/p><p><em>\u00a0<strong>\u00a0Las expropiaciones s\u00f3lo podr\u00e1n hacerse por causa de utilidad p\u00fablica y mediante indemnizaci\u00f3n. <\/strong><\/em><\/p><p><em>\u00a0<strong>La naci\u00f3n tendr\u00e1 en todo tiempo el derecho de imponer a la propiedad privada las modalidades que dicte el inter\u00e9s p\u00fablico, as\u00ed como el de regular, en beneficio social, el aprovechamiento de los elementos naturales susceptibles de apropiaci\u00f3n<\/strong>, con objeto de hacer una distribuci\u00f3n equitativa de la riqueza p\u00fablica, cuidar de su conservaci\u00f3n, lograr el desarrollo equilibrado del pa\u00eds y el mejoramiento de las condiciones de vida de la poblaci\u00f3n rural y urbana. En consecuencia, se dictar\u00e1n las medidas necesarias para ordenar los asentamientos humanos y establecer adecuadas provisiones, usos, reservas y destinos de tierras, aguas y bosques, a efecto de ejecutar obras p\u00fablicas y de planear y regular la fundaci\u00f3n,conservaci\u00f3n, mejoramiento y crecimiento de los centros de poblaci\u00f3n; para preservar y restaurar el equilibrio ecol\u00f3gico; para el fraccionamiento de los latifundios; para disponer, en los t\u00e9rminos de la ley reglamentaria, la organizaci\u00f3n y explotaci\u00f3n colectiva de los ejidos y comunidades; para el desarrollo de la peque\u00f1a propiedad rural; para el fomento de la agricultura, de la ganader\u00eda, de la silvicultura y de las dem\u00e1s actividades econ\u00f3micas en el medio rural, y para evitar la destrucci\u00f3n de los elementos naturales y los da\u00f1os que la propiedad pueda sufrir en perjuicio de la sociedad.<\/em><\/p><p><em>\u00a0(\u2026)\u201d<\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bebcdb8 elementor-widget elementor-widget-text-editor\" data-id=\"bebcdb8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Es necesario se\u00f1alar que, nuestra Carta Magna se divide en dos partes, la primera es la dogm\u00e1tica en donde se establecen los derechos humanos, las garant\u00edas constitucionales as\u00ed como las libertades sociales; y, la segunda es la parte org\u00e1nica, en la que se establece la forma que adopta el Estado para gobernarse, la creaci\u00f3n de los \u00f3rganos a trav\u00e9s de los cuales \u00e9ste ejerce sus atribuciones y los procedimientos para designar o elegir a los titulares de aquellos, la divisi\u00f3n de poderes, sus facultades y limitaciones.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8719659 elementor-widget elementor-widget-text-editor\" data-id=\"8719659\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Cabe mencionar que el art\u00edculo 27 de la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos, se encuentra en la parte dogm\u00e1tica y, por ende, protege la propiedad privada de los ciudadanos, ya que \u00e9sta no puede ser ocupada sin su consentimiento, salvo por causa de utilidad p\u00fablica y mediante indemnizaci\u00f3n.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b42f059 elementor-widget elementor-widget-text-editor\" data-id=\"b42f059\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En conclusi\u00f3n, la reforma a la Constituci\u00f3n de la Ciudad de M\u00e9xico, al adecuarse al art\u00edculo 133 de la Constituci\u00f3n Federal, esta no desconoce ni limita los derechos humanos de los ciudadanos, toda vez que el art\u00edculo primero de la Carta Magna se\u00f1ala que todas las personas gozar\u00e1n de los derechos humanos reconocidos en esta, as\u00ed como de las garant\u00edas para su protecci\u00f3n.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-81f93e2 elementor-widget elementor-widget-text-editor\" data-id=\"81f93e2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Se enfatiza en que todas las autoridades tienen la obligaci\u00f3n de promover, respetar, proteger y garantizar los derechos humanos de conformidad con los principios de universalidad, interdependencia, indivisibilidad y progresividad.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a4096f8 elementor-widget elementor-widget-text-editor\" data-id=\"a4096f8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Asimismo, las normas relativas a los derechos humanos se interpretar\u00e1n de conformidad con la Constituci\u00f3n Pol\u00edtica de los Estados Unidos Mexicanos, por lo tanto, el derecho a la propiedad privada no cambiar\u00e1, ni se vulnerar\u00e1 en la ciudad de M\u00e9xico. The property of the City over its assets of the public domain, of common use and of the private domain is recognized; likewise, the common land and communal property\u201d.<\/em><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3b85192b elementor-widget elementor-widget-text-editor\" data-id=\"3b85192b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>From the foregoing, it is clear that the core of this reform is that private property in Mexico City will now be respected in terms of Article 27 of the Political Constitution of the United Mexican States (CPEUM).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0e5e1b5 elementor-widget elementor-widget-text-editor\" data-id=\"0e5e1b5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>But what does this article establish with respect to private property?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-06108b4 elementor-widget elementor-widget-text-editor\" data-id=\"06108b4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em>Art 27. \u201cThe ownership of the lands and waters included within the limits of the national territory, corresponds originally to the Nation, which has had and has the right to transfer the domain thereof to private individuals, constituting private property.<\/em><\/p><p><em>\u00a0Expropriations may only be made for reasons of public utility and by means of compensation.<\/em><\/p><p><em>The nation shall at all times have the right to impose on private property the modalities dictated by the public interest, as well as to regulate, for the benefit of society, the use of natural elements susceptible of appropriation, in order to make an equitable distribution of public wealth, take care of its conservation, achieve the balanced development of the country and the improvement of the living conditions of the rural and urban population.
