Federaci\u00f3n (DOF) las disposiciones emitidas por la Secretar\u00eda del Trabajo y Previsi\u00f3n Social (STPS) en materia de factores de riesgo para garantizar el derecho al descanso durante la jornada laboral de las personas trabajadoras que realizan sus actividades de pie en los sectores de servicios, comercio, centros de trabajo an\u00e1logos y establecimientos industriales.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4522fd38 elementor-widget elementor-widget-text-editor\" data-id=\"4522fd38\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Dichas disposiciones tienen por objeto establecer los requisitos m\u00ednimos que deben cumplir los patrones para garantizar que los trabajadores que desempe\u00f1an sus funciones de pie (bipedestaci\u00f3n) cuenten con un n\u00famero suficiente de sillas, as\u00ed como con el tipo adecuado de estas.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3acba529 elementor-widget elementor-widget-text-editor\" data-id=\"3acba529\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">A partir de estas disposiciones, los patrones deber\u00e1n cumplir con las siguientes obligaciones:<\/p>\n\n<ol>\n \t<li class=\"p1\">Realizar un an\u00e1lisis espec\u00edfico sobre los trabajadores que desempe\u00f1an sus funciones de pie, el cual deber\u00e1 incorporarse al diagn\u00f3stico y programa de seguridad y salud en el trabajo, o bien, a la relaci\u00f3n de acciones preventivas y correctivas en materia de seguridad y salud laboral.<\/li>\n \t<li class=\"p1\">Registrar en las actas de los recorridos de verificaci\u00f3n de la Comisi\u00f3n de Seguridad e Higiene los riesgos de trabajo detectados en cada uno de los trabajadores que laboren de pie, as\u00ed como las medidas preventivas que se implementen.<\/li>\n \t<li class=\"p1\">Llevar a cabo una evaluaci\u00f3n del riesgo para cada trabajador que labore de pie, utilizando el procedimiento de puntaje establecido en las propias disposiciones.<\/li>\n \t<li class=\"p1\">Seleccionar la opci\u00f3n de asiento o silla m\u00e1s adecuada para los trabajadores, seg\u00fan el tipo de actividad que desempe\u00f1en, pudiendo ser: banco alto para quienes laboran de pie con apoyo ocasional; silla alta con respaldo medio para quienes alternan posturas; o silla ergon\u00f3mica ajustable en los casos en que las actividades puedan realizarse sentados.<\/li>\n \t<li class=\"p1\">Proveer a los trabajadores que laboran en bipedestaci\u00f3n el tipo de asiento m\u00e1s adecuado, conforme a la evaluaci\u00f3n del nivel de riesgo realizada.<\/li>\n \t<li>\n<p class=\"p1\">Implementar medidas preventivas para reducir riesgos laborales en trabajadores que desempe\u00f1an sus funciones de pie, que pueden ser entre otras:<\/p>\n\n<ol>\n \t<li>\n<p class=\"p1\">Contar con estaciones de trabajo que permitan el uso de sillas con respaldo y faciliten el movimiento de extremidades y tronco.<\/p>\n<\/li>\n \t<li>\n<p class=\"p1\">Alternar actividades que permitan el cambio de postura entre estar de pie y sentado.<\/p>\n<\/li>\n \t<li>\n<p class=\"p1\">Proporcionar calzado ergon\u00f3mico a los trabajadores en bipedestaci\u00f3n<\/p>\n<\/li>\n \t<li>\n<p class=\"p1\">Acondicionar las estaciones de trabajo con pisos de superficie amortiguada.<\/p>\n<\/li>\n \t<li>\n<p class=\"p1\">Establecer un programa de pausas conforme al estudio de riesgo realizado.<\/p>\n<\/li>\n<\/ol>\n<\/li>\n \t<li>Informar a los trabajadores que laboran de pie sobre los riesgos a los que est\u00e1n expuestos, as\u00ed como sobre las medidas de prevenci\u00f3n que ser\u00e1n implementadas en el centro de trabajo.<\/li>\n \t<li>Colocar se\u00f1alamientos en las \u00e1reas donde se ubiquen las sillas o asientos destinados al uso de las personas que laboren en bipedestaci\u00f3n, cuando estos se encuentren en espacios distintos a sus puestos de trabajo.\n<\/li>\n \t<li>\n<p class=\"p1\">Canalizar al servicio m\u00e9dico a aquellos empleados que laboren de pie y cuenten con s\u00edntomas de molestias relacionadas con esa postura.<\/p>\n<\/li>\n<\/ol>\n<p class=\"p1\">Cabe destacar que los patrones disponen de un plazo de 180 d\u00edas naturales a partir de la entrada en vigor de la denominada Ley Silla (ocurrida el 17 de junio de 2025) para adecuar su normativa interna conforme a estas nuevas disposiciones. Esto incluye, entre otros elementos, el Reglamento Interior de Trabajo y el programa de seguridad y salud en el trabajo. Dicho proceso deber\u00e1 concluir a m\u00e1s tardar el 14 de diciembre de 2025.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-644c169 elementor-widget elementor-widget-text-editor\" data-id=\"644c169\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">En <b>Rivadeneyra Trevi\u00f1o<\/b>, nos encontramos a sus \u00f3rdenes para asesorarlos en el an\u00e1lisis e implementaci\u00f3n de todoslos aspectos correspondientes a la denominada \u201cLey Silla\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-4d8fdbbf e-con-full e-flex e-con e-child\" data-id=\"4d8fdbbf\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4c432d79 elementor-widget elementor-widget-text-editor\" data-id=\"4c432d79\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">On July 17, 2025, the Official Gazette of the Federation (DOF) published the provisions issued by the Ministry of Labor and Social Welfare (STPS) regarding risk factors aimed at ensuring the right to rest during the workday for employees who perform their duties while standing in the service, commerce, analogous workplaces, and industrial establishments sectors.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a473462 elementor-widget elementor-widget-text-editor\" data-id=\"1a473462\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">The purpose of these provisions is to establish the minimum requirements that employers must meet to ensure that employees performing their duties in a standing position (bipedal stance) have access to a sufficient number of chairs, as well as to the appropriate type thereof.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a1b95dd elementor-widget elementor-widget-text-editor\" data-id=\"a1b95dd\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\">Pursuant to these provisions, employers must complywith the following obligations:<\/p>\n\n<ol>\n \t<li>Conduct a specific analysis regarding the employees who perform their duties standing, which must be incorporated into the workplace health and safety diagnosis and program, or into the list of preventive and corrective actions in occupational health and safety.\n<\/li>\n \t<li>Record, in the minutes of the verification rounds carried out by the Occupational Health and Safety Commission, the occupational risks identified for each worker performing duties while standing, as well as the preventive measures implemented.<\/li>\n \t<li>Carry out a risk assessment for each employee working in a standing position, using the scoring procedure set forth in the applicable provisions.<\/li>\n \t<li class=\"p1\" style=\"word-spacing: -2px; letter-spacing: 0.0px;\">Select the most appropriate type of seat or chair for the employees, based on the nature of the activities they perform, which may include: a high stool for those who stand with occasional support; a tall chair with mid-backrest for those who alternate between sitting and standing; or an adjustable ergonomic chair for cases where the tasks may be performed while seated.<\/li>\n \t<li class=\"p1\">Provide employees working in a standing position with the type of seat most suitable according to the risk level assessment carried out.<\/li>\n \t<li class=\"p1\">Implement preventive measures to reduce occupational risks for employees performing duties while standing, which may include, among others:\n<\/p><ol>\n\n \t<li>\n<p class=\"p1\" style=\"word-spacing:5px; letter-spacing:1.0px\">Equipping workstations with chairs with backrests and allowing movement of limbs and torso.<\/p><\/li>\n \t<li>\n<p class=\"p1\">Alternating tasks to enable posture changes between standing and sitting.<\/p>\n<\/li>\n \t<li>\n<p class=\"p1\">Providing ergonomic footwear to employees working in a standing position.<\/p>\n<\/li>\n \t<li>\n<p class=\"p1\" style=\"word-spacing:4px;
