Federaci\u00f3n (DOF) un decreto emitido por la Presidencia de la Rep\u00fablica mediante el cual se reforma el art\u00edculo 123 constitucional en materia de reducci\u00f3n de la jornada laboral.<\/p><p>A continuaci\u00f3n, presentamos los principales puntos a considerar del decreto:<\/p><ol><li>La jornada laboral tendr\u00e1 una duraci\u00f3n de cuarenta horas semanales.<\/li><li>Se mantiene un d\u00eda de descanso semanal por cada seis de trabajo.<\/li><li>La jornada extraordinaria no podr\u00e1 exceder de 12 horas a la semana y podr\u00e1 distribuirse hasta en cuatro horas diarias, en un m\u00e1ximo de cuatro d\u00edas.<\/li><li>Las primeras 12 horas extraordinarias semanales deber\u00e1n pagarse con un 100 % adicional al salario ordinario; las que excedan de dicho l\u00edmite deber\u00e1n pagarse con un 200 % adicional.<\/li><li>Queda prohibido que los menores de dieciocho a\u00f1os laboren tiempo extraordinario.<\/li><li>La reducci\u00f3n de la jornada laboral se implementar\u00e1 de forma gradual del 1 de enero de 2027 al 1 de enero de 2030, en los siguientes t\u00e9rminos:<\/li><\/ol><table><tbody><tr><td width=\"189\"><strong>A\u00d1O<\/strong><\/td><td width=\"227\"><strong>JORNADA SEMANAL<\/strong><\/td><\/tr><tr><td width=\"189\">2027<\/td><td width=\"227\">46<\/td><\/tr><tr><td width=\"189\">2028<\/td><td width=\"227\">44<\/td><\/tr><tr><td width=\"189\">2029<\/td><td width=\"227\">42<\/td><\/tr><tr><td width=\"189\">2030<\/td><td width=\"227\">40<\/td><\/tr><\/tbody><\/table><ol start=\"7\"><li>A partir de la publicaci\u00f3n del decreto, el Congreso de la Uni\u00f3n cuenta con un plazo de 90 d\u00edas para reformar la Ley Federal del Trabajo, de conformidad con lo anterior.<\/li><\/ol><p>Esta reforma representa un cambio trascendental para la vida laboral y social de M\u00e9xico. Su implementaci\u00f3n implicar\u00e1 para las empresas la necesidad de realizar ajustes estructurales organizacionales, lo que supondr\u00e1 retos no solo financieros, sino tambi\u00e9n log\u00edsticos y operativos.<\/p><p>Como se ha se\u00f1alado, la Ley Federal del Trabajo deber\u00e1 ser reformada a fin de armonizarse con el nuevo marco constitucional en materia de jornada laboral. Se prev\u00e9 que dichas modificaciones otorguen mayor claridad respecto de la implementaci\u00f3n y aplicaci\u00f3n de las nuevas reglas sobre jornada extraordinaria, entre otros aspectos.<\/p><p>Si bien la reducci\u00f3n de la jornada laboral se implementar\u00e1 de forma gradual, resulta recomendable que las empresas inicien desde ahora un proceso de evaluaci\u00f3n de sus operaciones y esquemas de trabajo, a fin de prepararse para la adopci\u00f3n de los nuevos l\u00edmites de la jornada laboral.<\/p><p>Recomendamos que la evaluaci\u00f3n de las operaciones de la empresa no se limite al an\u00e1lisis de los turnos de trabajo, sino que incluya tambi\u00e9n la identificaci\u00f3n de \u00e1reas de mejora orientadas a incrementar la eficiencia de los procesos y la productividad, considerando igualmente aspectos relacionados con la capacitaci\u00f3n de las personas trabajadoras.<\/p><p>En Rivadeneyra Trevi\u00f1o estamos dando seguimiento a esta reforma y quedamos a sus \u00f3rdenes para resolver cualquier duda relacionada con este tema, as\u00ed como para apoyarles en la planeaci\u00f3n y evaluaci\u00f3n de las implementaciones correspondientes.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-7760cbab e-con-full e-flex e-con e-child\" data-id=\"7760cbab\" data-element_type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-38df0e72 elementor-widget elementor-widget-text-editor\" data-id=\"38df0e72\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>On March 3, 2026, a decree issued by the President of Mexico was published in the <em>Official Gazette of the Federation<\/em> (Diario Oficial de la Federaci\u00f3n \u2013 DOF), amending Article 123 of the Mexican Constitution with respect to the reduction of the statutory workweek.<\/p><p>The key aspects of the decree are summarized below:<\/p><ol><li>The statutory workweek will be reduced to forty hours per week.<\/li><li>The right to one day of rest for every six days worked will remain in place.<\/li><li>Overtime may not exceed 12 hours per week and may be distributed up to four hours per day, for a maximum of four days.<\/li><li>The first 12 overtime hours per week must be paid with a 100% premium over the regular salary; any overtime exceeding this limit must be paid with a 200% premium.<\/li><li>Individuals under eighteen years of age are prohibited from working overtime.<\/li><li>The reduction of the workweek will be implemented gradually from January 1, 2027, through January 1, 2030, as follows:<\/li><\/ol><table><tbody><tr><td width=\"189\"><strong>YEAR <\/strong><\/td><td width=\"227\"><strong>WEEKLY HOURS<\/strong><\/td><\/tr><tr><td width=\"189\">2027<\/td><td width=\"227\">46<\/td><\/tr><tr><td width=\"189\">2028<\/td><td width=\"227\">44<\/td><\/tr><tr><td width=\"189\">2029<\/td><td width=\"227\">42<\/td><\/tr><tr><td width=\"189\">2030<\/td><td width=\"227\">40<\/td><\/tr><\/tbody><\/table><ol start=\"7\"><li>Following publication of the decree, the Mexican Congress has a 90-day period to amend the Federal Labor Law in order to align it with the constitutional reform.<\/li><\/ol><p>This reform represents a significant development for Mexico\u2019s labor and social landscape. Its implementation will require companies to undertake structural adjustments to their organization and operations, posing challenges not only from a financial perspective but also from logistical and operational standpoints.<\/p><p>As noted above, the Federal Labor Law will need to be amended to align with the new constitutional framework governing working hours. These amendments are expected to provide greater clarity regarding the implementation and application of the new overtime rules, among other matters.<\/p><p>Although the reduction of the workweek will be implemented gradually, companies are encouraged to begin evaluating their operations and work structures in order to prepare for the adoption of the new statutory working hour limits.<\/p><p>Such evaluations should not be limited to reviewing work shift structures but should also include the identification of operational improvements aimed at increasing efficiency and productivity, including initiatives related to employee training.<\/p><p>Rivadeneyra Trevi\u00f1o is closely monitoring this reform and remains available to address any questions regarding its implications, as well as to
