El 07 de agosto de 2026 se public\u00f3 el acuerdo por el que se modifican las Reglas de Car\u00e1cter General a que se refiere la Ley Federal para la Prevenci\u00f3n e Identificaci\u00f3n de Operaciones con Recursos de Procedencia Il\u00edcita (\u201cLFPIORPI\u201d), aplicables a quienes realizan Actividades Vulnerables. La modificaci\u00f3n aborda detalles sobre las obligaciones nuevas plasmadas en la reforma a la LFPIORPI que entr\u00f3 en vigor el 17 de julio de 2025 y ampl\u00eda de manera significativa las cargas de cumplimiento, siendo relevantes las siguientes:<\/p>

ENFOQUE BASADO EN RIESGOS<\/strong><\/p>

Se incorpora un cap\u00edtulo completo que obliga a dise\u00f1ar e implementar una metodolog\u00eda propia para evaluar el Riesgo de la actividad, de los Clientes o Usuarias, de las transacciones y de los canales de distribuci\u00f3n, la cual deber\u00e1 tener una revisi\u00f3n peri\u00f3dica obligatoria.<\/p>

  • Clasificaci\u00f3n del Grado de Riesgo: <\/strong>Los sujetos obligados deber\u00e1n clasificar a sus Clientes o Usuarias en, al menos, Riesgo bajo, medio y alto, y deber\u00e1n llevar a cabo la evaluaci\u00f3n del Grado de Riesgo al menos cada seis meses.<\/li>
  • Aplica antes de lanzar productos o servicios nuevos: <\/strong>toda nueva modalidad, canal o tipo de Cliente debe evaluarse en Riesgo antes de ponerse en marcha.<\/li><\/ul>

    CONOCIMIENTO DE LA PERSONA CLIENTE O USUARIA<\/strong><\/p>

    Quienes realicen Actividades Vulnerables estar\u00e1n obligadas a elaborar y observar una pol\u00edtica de conocimiento de sus Clientes o Usuarias, considerar el Perfil Transaccional, lo cual deber\u00e1 evaluarse al menos cada seis meses e implementar un sistema de alertas que permita el seguimiento y detecci\u00f3n de cambios en el Perfil Transaccional.<\/p>

    • Se implementan medidas reforzadas de monitoreo para clientes de alto riesgo y Personas Pol\u00edticamente Expuestas (PEP).<\/li><\/ul>

      BENEFICIARIO CONTROLADOR<\/strong><\/p>

      La reforma dedica un cap\u00edtulo espec\u00edfico a la identificaci\u00f3n del Beneficiario Controlador, con un orden de prelaci\u00f3n obligatorio y reglas puntuales para fideicomisos y estructuras jur\u00eddicas.<\/p>

      • Orden de prelaci\u00f3n de tres niveles: <\/strong>(i) persona f\u00edsica con 25% o m\u00e1s del capital social; (ii) persona f\u00edsica con control por otros medios vinculado a la direcci\u00f3n y toma de decisiones; (iii) persona f\u00edsica o grupo de personas que ocupa la posici\u00f3n de funcionario administrativo de mayor grado o de alta direcci\u00f3n.<\/li>
      • Debe documentarse el procedimiento seguido para la identificaci\u00f3n, <\/strong>conservar la informaci\u00f3n, documentaci\u00f3n y registros que la sustenten, mantenerlos actualizados durante la vigencia de la Relaci\u00f3n de negocios y resguardarlos.<\/li><\/ul>

        MECANISMOS AUTOMATIZADOS<\/strong><\/p>

        Se define con mayor precisi\u00f3n qu\u00e9 funciones deben cubrir. Debe ser verificable ante el SAT y la UIF, no basta con tener el mecanismo implementado; su funcionamiento y trazabilidad deben poder acreditarse documentalmente en cualquier momento, as\u00ed como contar con funciones m\u00ednimas obligatorias plasmadas en las reglas.<\/p>

        AUDITOR\u00cdA<\/strong><\/p>

        Deber\u00e1n mantenerse medidas de control que incluyan la revisi\u00f3n de un auditor, ya sea de su \u00e1rea de auditor\u00eda interna o de un auditor externo independiente.<\/p>

        Dictamen anual: <\/strong>el auditor evaluar\u00e1 y dictaminar\u00e1, respecto del periodo comprendido del primero de enero al treinta y uno de diciembre de cada a\u00f1o, la efectividad del cumplimiento de la Ley, su Reglamento y las reglas.<\/p>

        CAPACITACI\u00d3N<\/strong><\/p>

        Las reglas ampl\u00edan el est\u00e1ndar de los programas de capacitaci\u00f3n y selecci\u00f3n de personal.<\/p>

        • Impartici\u00f3n de cursos o talleres: <\/strong>deber\u00e1n realizarse por lo menos una vez al a\u00f1o.<\/li>
        • Evaluaci\u00f3n y consecuencias: <\/strong>se deben aplicar evaluaciones de conocimientos a los participantes y el Manual de Pol\u00edticas Internas debe prever qu\u00e9 medidas se toman con quienes no obtengan resultados satisfactorios.<\/li><\/ul>

          OTROS AJUSTES RELEVANTES<\/strong><\/p>

          • Deber\u00e1 reforzarse y actualizarse el Manual de Pol\u00edticas Internas conforme a lo dispuesto por la modificaci\u00f3n a las reglas.<\/li>
          • Se crea un procedimiento de alta espec\u00edfico para quienes prestan servicios de activos virtuales, adicional al tr\u00e1mite general.<\/li>
          • Se precisan las reglas de acumulaci\u00f3n y aviso para copropietarios en arrendamiento de inmuebles.<\/li><\/ul>

            El acuerdo entrar\u00e1 en vigor, de manera general, el 30 de noviembre de 2026.<\/p>

            On August 7, 2026, the resolution amending the General Rules issued under the Federal Law for the Prevention and Identification of Transactions Involving Illicit Funds (the \u201cLFPIORPI\u201d) was published, applicable to those who carry out Vulnerable Activities. The amendment addresses details regarding the new obligations set forth in the LFPIORPI reform that entered into force on July 17, 2025, and significantly expands compliance obligations. The most relevant points are the following:<\/p>

            RISK-BASED APPROACH<\/strong><\/p>

            A full chapter has been added requiring the design and implementation of an in-house methodology to assess the Risk of the activity, of Clients or Users, of transactions, and of distribution channels, which shall be subject to mandatory periodic review.<\/p>

            • Risk Level classification: <\/strong>Obligated parties must classify their Clients or Users into at least low, medium, and high Risk, and must reassess the Risk Level at least every six months.<\/li><\/ul>
              • Applies before launching new products or services: <\/strong>any new modality, channel, or type of Client must undergo a Risk assessment before being rolled out.<\/li><\/ul>

                KNOWLEDGE OF THE CLIENT OR USER<\/strong><\/p>

                Persons carrying out Vulnerable Activities are required to establish and adhere to a customer and user due diligence policy, take into account each customer’s Transactional Profile, which must be assessed at least every six months, and implement an alert system that enables the monitoring and detection of changes in such Transactional Profile.<\/p>

                • Enhanced monitoring measures are implemented for high-risk clients and Politically Exposed Persons (PEPs).<\/li><\/ul>

                  ULTIMATE BENEFICIAL OWNER (UBO)<\/strong><\/p>

                  The reform devotes a specific chapter to identifying the Ultimate Beneficial Owner, establishing a mandatory order of precedence and specific rules for trusts and legal structures.<\/p>

                  • Three-tier order of precedence: <\/strong>(i) an individual holding 25% or more of the capital stock; (ii) an individual exercising control through other means linked to management and decision-making; (iii) the individual or group of individuals holding the highest-ranking administrative or senior management position.<\/li>
                  • The identification procedure followed must be documented, <\/strong>and the supporting information, documentation, and records must be retained, kept up to date throughout the Business Relationship, and properly safeguarded.<\/li><\/ul>

                    AUTOMATED MECHANISMS<\/strong><\/p>

                    The rules more precisely define the functions these mechanisms must perform. Compliance must be verifiable to both the SAT and the UIF; it is not enough merely to have the mechanism in place. Its operation and traceability must be capable of being documented and evidenced at any time, and it must also incorporate the minimum mandatory functionalities set out in the rules.<\/p>

                    AUDIT<\/strong><\/p>

                    Control measures must be maintained, including a review by an auditor, whether from the internal audit area or an independent external auditor.<\/p>

                    Annual opinion: <\/strong>the auditor will evaluate and issue an opinion, for the period from January 1 to December 31 of each year, on the effectiveness of compliance with the Law, its Regulations, and the Rules.<\/p>

                    TRAINING<\/strong><\/p>

                    The rules raise the standard for training and personnel selection programs.<\/p>

                    • Delivery of courses or workshops: <\/strong>must be conducted at least once a year.<\/li>
                    • Assessment and consequences: <\/strong>knowledge assessments must be administered to participants, and the Internal Policies Manual must set out the measures to be taken with respect to those who do not achieve satisfactory results.<\/li><\/ul>

                      OTHER RELEVANT CHANGES<\/strong><\/p>

                      • The Internal Policies Manual must be strengthened and updated pursuant to the amendments to the Rules.<\/li>
                      • A specific registration procedure is created for virtual asset service providers, in addition to the general procedure.<\/li>
                      • The rules on threshold aggregation and reporting are clarified for co-owners leasing real property.<\/li><\/ul>

                        The resolution will generally enter into force on November 30, 2026.<\/p>
